Our firm is currently representing a group of workers against their former employer for violation of the Fair Labor Standards Act. The employer, a bi-lingual special needs school allegedly failed to pay its teachers for almost a year. The teachers did not speak up right away out of fear of retaliation. The State Comptroller’s office investigated the employer and discovered it had fraudulently billed the State of New York for millions of dollars. Pardalis & Nohavicka, LLP filed a collective action / class action lawsuit on behalf of the employees for unpaid wages under the Fair Labor Standards Act (FLSA). Our firm is also handling the defense of several restaurateurs whose employees have claimed unpaid wages and tip spreading under the Fair Labor Standards Act (FLSA). In one matter two former employees are claiming that they were never paid wages and worked for years at the clients establishment. Our position is that both employees were paid in cash and paid well above what was required. The matter is being litigated in The United States federal Court for the Eastern District of New York.
