Premises Liability: Bunk Bed Head Bump

Maria L., was employed as a housekeeper and babysitter for about a year. She hit her head on a ceiling beam at the home while coming down a bunk bed ladder. Maria L. sued for injuries. She admitted that she was aware of the ceiling beam and its location in relation to the bunk bed ladder, and she had changed the linens at least 50 times. The appellate court ruled that the ceiling beam did not create an inherently dangerous condition and was readily observable by the reasonable use of one’s senses. Case dismissed.
